Business Associate Agreement (BAA)
Any third-party vendor that creates, receives, maintains, or transmits PHI on behalf of a covered entity must sign a Business Associate Agreement. This is non-negotiable.
Many popular AI tools�including some well-known chatbot and automation platforms�do not offer BAAs, or offer them only on enterprise plans. Before connecting any AI tool to systems containing patient data, confirm BAA availability.
Data Encryption
PHI must be encrypted both in transit (when data is moving between systems) and at rest (when data is stored). Verify that any AI platform you use meets minimum encryption standards (AES-256 for storage, TLS 1.2+ for transmission).
Access Controls
The AI system must enforce appropriate access controls�ensuring that only authorized users and systems can access PHI. This includes role-based access, audit logging, and session management.
Audit Trails
HIPAA requires covered entities to maintain audit logs of PHI access and activity. Your AI system should log who accessed what data, when, and what actions were taken.
Minimum Necessary Standard
AI systems should be designed to use only the minimum PHI necessary to accomplish the task. Don’t feed full patient records to an AI agent when only appointment date and contact information are needed.
Where Common AI Tools Fall Short

No BAA available. Tools like standard ChatGPT, many Zapier integrations, and consumer-facing AI assistants do not offer BAAs. Using these with PHI creates immediate HIPAA exposure.
Data used for model training. Some AI platforms use user inputs to train or improve their models. This is explicitly problematic when that input contains PHI. Always review the vendor’s data use policy.
Inadequate logging. Consumer and SMB-tier AI tools often lack the audit logging depth that HIPAA requires. “We log API calls” is not the same as a HIPAA-grade audit trail.
Third-party integrations. When AI automation connects your EHR to an email platform to a scheduling tool, each connection is a potential data transfer point. Each vendor in that chain needs to be evaluated for HIPAA compliance.
Cloud data residency. PHI processed by cloud AI services may be stored or processed in jurisdictions that create additional compliance complexity.
